Our website is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you.

2. These terms

These Terms and Conditions apply when you use our website or purchase products from us through it.

Please read them before placing an order. By placing an order, you agree to these terms together with our:

  • Returns and Refunds Policy

  • Shipping and Delivery Policy

  • Privacy Policy

Nothing in these terms affects your statutory rights as a consumer.

You must be at least 18 years old and legally capable of entering into a contract to place an order through our website.

3. Product information

We take reasonable care to ensure that product descriptions, photographs, dimensions and other information are accurate.

Because many of our products are handmade, minor variations may occur between individual pieces. Measurements may also vary slightly because of the handmade nature of the products.

Leather, Harris Tweed, wood and other natural materials may display variations in colour, grain, texture, markings and shade. These natural characteristics are not necessarily defects and contribute to the individual appearance of each product.

Distressed and vintage-style leathers are intentionally produced with variations, markings and changes in tone.

The appearance of colours may also vary according to your screen, device settings and lighting. If an exact colour match is important, please contact us before ordering.

Nothing in this section excludes your rights where a product is faulty, materially different from its description or not of satisfactory quality.

4. Product availability

All products are subject to availability.

We may change or discontinue products and may correct errors in product descriptions, prices or availability information.

If we cannot supply a product after you have placed an order, we will contact you and refund any amount paid for the unavailable product.

5. Placing an order

When you place an order through our website, you are offering to purchase the products shown in your order.

After you submit an order, you should receive an acknowledgement by email. This confirms that we have received your order but does not necessarily mean that it has been accepted.

A contract is formed when we confirm that we have accepted your order.

We may decline or cancel an order for a legitimate reason, including:

  • The product is unavailable

  • Payment cannot be authorised

  • There is an obvious error in the price or product information

  • We cannot deliver to the supplied address

  • We reasonably suspect fraud or unauthorised activity

If we cannot accept an order after payment has been taken, we will refund the amount paid.

Please check your order information carefully before submitting it and contact us promptly if anything is incorrect.

6. Made-to-order and bespoke products

Some of our furniture is manufactured after an order is placed.

A product will only be treated as made to your specifications or clearly personalised where it incorporates genuinely bespoke elements, such as:

  • Special or non-standard dimensions

  • Alterations requested specifically by you

  • Personalised embroidery

  • Materials that are not part of our standard range

Selecting a standard size, leather, fabric or colour offered as a normal product option does not automatically make a product bespoke or personalised.

Cancellation rights may not apply to products made to your specifications or clearly personalised. Please see our Returns and Refunds Policy for further information.

If you ask to cancel a bespoke order before dispatch, we will review the request individually, taking account of whether materials have been ordered, cut or committed and whether production has begun.

Your statutory rights remain unaffected if a bespoke or made-to-order product is faulty, damaged or not as described.

7. Prices and payment

Prices are shown in pounds sterling and include UK VAT where applicable, unless expressly stated otherwise.

Free standard delivery is included for eligible addresses in England, Wales and standard delivery areas of Scotland. Additional delivery charges may apply to remote or offshore locations, as explained in our Shipping and Delivery Policy.

The price payable is the price displayed when you place your order, subject to the correction of obvious errors.

If we discover an obvious pricing error, we will contact you before accepting or fulfilling the order. You may choose to continue at the correct price or cancel the order for a full refund.

Payment must be made using one of the payment methods available at checkout. You confirm that you are authorised to use the selected payment method.

8. Delivery

Our delivery areas, estimated delivery times, possible additional charges and access requirements are explained in our Shipping and Delivery Policy.

We aim to deliver orders within 10–15 working days after receiving payment unless a different estimate is displayed or agreed.

Delivery times are estimates unless we expressly agree a guaranteed delivery date.

We remain responsible for products while they are being delivered by a carrier arranged by us. Responsibility for the products passes to you when they are delivered to you or to a person you have authorised to receive them.

You must provide complete and accurate delivery and contact information. Reasonable additional charges may apply if delivery fails because:

  • Incorrect or incomplete information was provided

  • Nobody is available at an agreed delivery time

  • You did not disclose relevant access restrictions

  • The product cannot fit through the available access route despite accurate product dimensions being supplied

Please check all doorways, hallways, stairways, lifts and other access points before ordering.

Nothing in this section limits your legal rights where we fail to deliver within an agreed or legally required time.

9. Returns, cancellations and exchanges

Your rights to cancel an order or return a product are explained in our Returns and Refunds Policy.

For eligible products that are not made to your specifications or personalised, we offer a 30-day period in which to notify us that you wish to make a change-of-mind return.

Customers are responsible for arranging and paying for change-of-mind return transport.

We do not process direct exchanges. If you require a different product, the original product must be returned in accordance with our policy and a new order placed separately.

These provisions do not affect your statutory rights.

10. Faulty, damaged or incorrect products

We are legally required to supply products that are:

  • Of satisfactory quality

  • Fit for their intended purpose

  • As described

If a product is faulty, damaged when delivered, incorrect or not as described, please contact us as soon as reasonably possible.

We may ask for photographs and information to help us assess the problem. Depending on the circumstances and your legal rights, an appropriate remedy may include a repair, replacement, price reduction or refund.

We will be responsible for reasonable return or collection costs where the product does not conform to the contract and the law requires us to bear those costs.

We ask that visible delivery damage is reported within 48 hours, with photographs of the product and packaging where possible. This helps us investigate promptly with the carrier, but it does not remove or restrict your statutory rights if an issue is reported later.

11. Website use

You may use our website only for lawful purposes.

You must not:

  • Use the website fraudulently or unlawfully

  • Attempt to gain unauthorised access to the website or related systems

  • Introduce viruses, malware or other harmful material

  • Interfere with the website’s operation or security

  • Collect information about other users without authority

  • Copy or exploit website content for commercial purposes without permission

  • Use the website in a way that infringes another person’s rights

We may suspend or restrict access where reasonably necessary to protect the website, our business or other users.

12. Intellectual property

The content of this website, including its text, product descriptions, photographs, graphics, logos, videos and design, belongs to Klassic Upholstery Limited or is used with the permission of its respective owner.

You may view and use the website for personal, non-commercial purposes.

You must not reproduce, distribute, modify, republish or commercially exploit our content without our prior written permission, except where permitted by law.

Shopify’s name, trademarks and technology remain the property of Shopify or its licensors.

13. Third-party services and links

Our website may contain links to third-party websites or use services provided by third parties, including payment providers and delivery companies.

We are not responsible for the content or operation of third-party websites that we do not control. You should review their applicable terms and privacy policies before using them.

Purchases made directly from Klassic Upholstery Limited remain contracts between you and Klassic Upholstery Limited. Shopify is not the seller of our products and is not responsible for fulfilling your order.

14. Personal information

We process personal information in accordance with our Privacy Policy.

Because our website is hosted by Shopify, information supplied through the website may also be processed by Shopify and by service providers used to operate the store, process payments and fulfil orders.

Please read our Privacy Policy for further information about how personal information is collected, used, retained and shared.

15. Reviews and submitted content

If you submit a review, photograph or other content to us, you confirm that:

  • The content is truthful and based on your genuine experience

  • You own it or have permission to submit it

  • It does not infringe another person’s rights

  • It is not unlawful, abusive, defamatory or misleading

  • Any incentive or benefit connected with the review has been disclosed

You give us a non-exclusive, worldwide, royalty-free permission to display and reproduce the submitted content for the operation and promotion of our business.

We may moderate or remove submitted content where we reasonably believe it is unlawful, misleading, offensive or infringes another person’s rights.

16. Events outside our reasonable control

We are not responsible for a delay or failure caused by an event outside our reasonable control.

If such an event significantly affects your order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect.

If there is a substantial delay, you may have the right to cancel the affected order and receive a refund for products you have paid for but not received.

This section does not remove any rights you have under consumer law.

17. Our responsibility to you

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Breach of your statutory consumer rights

  • Any other liability that cannot legally be excluded or limited

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed.

Products sold through our consumer website are intended for private and domestic use. We are not responsible for business losses, including loss of profits, revenue, contracts or business opportunities, arising from consumer purchases.

18. Changes to these terms

We may update these terms to reflect changes to our business, website, products or legal obligations.

The terms applying to an order are those in effect when the order is placed. Later changes will not retrospectively alter an existing contract unless required by law or agreed with you.

19. Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

20. Governing law

These terms and contracts made through our website are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.

Nothing in this section removes any mandatory consumer protection available to you under applicable law.
